Bayfield Heights Condominiums is a small condominium community in Fountain Hills, AZ, consisting of just two units. You own your individual unit (including a garage) and share ownership of the common elements with the other unit owner. The association manages the property and is governed by this declaration.
- What you own & maintain: You own the interior of your unit (walls, floors, ceilings as finished) plus the garage assigned to your unit. You are responsible for maintaining your unit's interior, the limited common elements allocated to your unit (patio, backyard, garage door, windows, doors, HVAC, water heater, etc.), and the roof above your unit. The association maintains all common elements (exteriors, parking, landscaping, etc.) and structural parts of limited common elements.
- Assessments & fees: Each unit pays an equal 50% share of common expenses via annual assessments set by the board. Assessments are due in installments as determined by the board. Unpaid assessments accrue 10% annual interest plus late fees and attorneys' fees. Special assessments require 100% approval of unit owners present at a meeting.
- Parking & vehicles: Routine overnight parking of daily-use vehicles is permitted. Boats, RVs, trailers, and vehicles not in daily use may not be stored in the driveway for more than 72 hours in any 30-day period. No storage of such items on common elements or limited common elements visible from the street.
- Use restrictions: No dumping of trash, no storage on common elements (except patio furniture in back), no clotheslines, no exterior sound devices except security, no nuisance activities. Exterior fires allowed only in approved barbecue or fire pit receptacles in limited common elements. All units must comply with applicable laws and zoning.
- Insurance: The association carries property insurance on the common elements (at least 80% replacement cost) and liability insurance. Each unit owner is an insured for liability arising from common element ownership. Owners may buy their own insurance for their unit and personal property. Insurance proceeds for common element losses are held by the association for repair.
- Dispute resolution: Any disputes under the declaration must first go to mediation in Maricopa County. If not resolved, mandatory binding arbitration follows (under Arizona's arbitration act). The losing party may be ordered to pay the winning party's out-of-pocket costs.
