What The Sheffields's governing documents say
The Sheffields is a two-unit condominium community in Fountain Hills, AZ. You own your individual unit (A or B) and share the common elements equally with the other owner. The association maintains common areas, and you must follow the rules in this Declaration, Bylaws, and Articles. This document applies to owners, tenants, guests, and anyone using the property.
- Use & occupancy restrictions: Each unit is for single-family residential use only. No business, trade, or gainful occupation is allowed. You cannot place solar collectors, satellite dishes, or antennas visible from neighboring property without the adjacent owner's consent. Outside clotheslines, inoperable vehicles visible from neighboring property, and nuisances are prohibited.
- Alterations & improvements: Nonstructural interior changes do not need approval from the adjacent unit owner, but you are liable for any damage they cause. Any structural additions, alterations, or changes to exterior color or texture require prior written approval from the adjacent unit owner.
- Maintenance responsibilities: You must maintain, repair, and replace all portions of your unit and the limited common elements allocated to you (e.g., exterior doors, windows, porches, balconies). If the association fails to maintain common elements, each owner must maintain the common area contiguous to their unit. You are liable for damage caused by your negligence.
- Assessments & fees: Common expenses are allocated equally between the two units. The board adopts an annual budget and may levy monthly assessments. If you fail to pay, the association can impose late penalties and eventually file a lien. The assessment lien is subordinate to any first mortgage.
- Architectural review: The association's Architectural Committee (at least 2 members) regulates external design. Additionally, the property is subject to the Fountain Hills Committee of Architecture. If rules conflict, the more restrictive applies.
- Dispute resolution: Disputes between unit owners must first be resolved through written notice and a 21-day cure period. If not resolved, the matter goes to binding arbitration selected by the parties or by the Maricopa County Superior Court. The arbitrator's decision is binding and must be complied with within 30 days.
- Insurance: Each unit owner must maintain fire, casualty, and liability insurance on their unit with a carrier rated B+ or better. Minimum liability coverage is $500,000 per unit owner and the adjacent owner jointly. Proof of insurance must be provided to the adjacent owner.
