Edgeworth Twins Condominiums is a two-unit condominium community in Fountain Hills, Arizona. You own your individual unit (Unit A or B) and share ownership of the common elements equally with the other unit owner. The association handles common expenses and maintenance, but many decisions require approval from the adjoining unit owner.
- What you own & maintain: Each unit consists of the interior spaces within the exterior walls, slab, and roof. You are responsible for maintaining your unit and the limited common elements assigned to it (e.g., exterior doors, windows, patios). The association maintains the common elements, but if it fails, each unit owner must maintain the common area contiguous to their unit.
- Use restrictions: Units are for single-family residential use only. No business, nuisance, or illegal activity is allowed. Outside clotheslines, vehicle repairs visible from neighboring property, and inoperable vehicles are prohibited. Solar devices and satellite dishes require adjoining unit owner approval if visible.
- Architectural review: Any structural alterations or changes to the exterior color or texture require prior written approval from the adjoining unit owner. The community is also subject to the Fountain Hills Committee of Architecture, which has its own rules. In case of conflict, the most restrictive rule applies.
- Dispute resolution: If a dispute arises between unit owners, the complaining owner must give written notice. The owners have 21 days to settle before the matter goes to binding arbitration. The arbitrator is agreed upon by both parties or selected by the Maricopa County Superior Court.
- Assessments & fees: Common expenses are assessed equally between the two units based on each unit's 50% interest. The association may levy assessments to cover the budget. Delinquent assessments can become a lien, but any such lien is subordinate to first mortgages.
- Rights of first mortgagees: The declaration includes extensive protections for mortgage lenders, including notice of delinquencies, insurance changes, and required approval for amendments affecting certain matters (e.g., voting rights, assessments, leasing restrictions). No right of first refusal exists on unit sales.
