Aston Villas II is a 2-unit condominium in Fountain Hills, AZ. You own your unit and share the common elements, which the association maintains. This document is the full rulebook binding unit owners.
- Use & occupancy: Each unit and its limited common elements are for single-family residential use only. No business or gainful occupation is allowed, though you may keep a personal office.
- Exterior alterations & design: Structural additions or changes to the exterior (including color) require prior written approval from the owner of the adjoining unit. Solar collectors, satellite dishes, and antennas visible from neighboring property are prohibited without that owner's consent.
- What you own & maintain: You own the interior of your unit (including interior partitions and fixtures) and must maintain it. You also must maintain the limited common elements allocated to your unit (e.g., yard, patio). The association maintains the common elements.
- Assessments: Common expenses are assessed equally between the two units. Each unit has one vote in the association.
- Leasing & rentals: The declaration does not set a minimum lease term or restrict leasing, but lease terms must comply with mortgagee rights. Unit owners are responsible for their tenants' compliance with the rules.
- Duration & amendments: The declaration runs for 20 years from recording and automatically renews for successive 10-year periods. Amendments require unanimous unit owner consent (100% vote) except in limited circumstances.
- Dispute resolution: Disputes between unit owners must first go through a 21-day negotiation period, then binding arbitration by the American Arbitration Association.
