What Villas at Firerock Condominiums's governing documents say
Villas at FireRock is a condominium community in Fountain Hills, AZ — you own your individual unit and share undivided ownership of the common elements (25% each initially, up to 1/26 at full build-out). The association maintains roofs, stucco, common landscaping, and private roads; you maintain your unit's interior, windows, doors, garage doors, and private patio. There is also a master association (FireRock Community Association) that may impose additional rules.
- What you own & maintain: You own the interior of your residential dwelling and the yard/private patio. The association maintains roofs, stucco, painted exterior surfaces (but not windows, doors, or garage doors), private drives, common landscaping, and utility lines up to your unit. Party walls between units are shared maintenance responsibilities as outlined in the declaration.
- Leasing & rentals: Leases must be in writing, for at least 90 days, and subject to the governing documents. The unit owner must provide the association with the lease term and occupant names at least 10 days before move-in. The owner is liable for any violations by tenants or their guests.
- Pets: Only house pets allowed; no more than 2 dogs per unit regardless of size. Pets must be on a leash (max 6 feet) when outside the unit and under direct control. Owners must clean up after pets and prevent nuisance noise or odor. Board can further restrict pet size/number by rule.
- Parking & vehicles: Only family vehicles (cars, SUVs, pickups under 1 ton, etc.) may be parked on the property. Commercial vehicles, boats, RVs, and trailers are prohibited except when loading/unloading (max 8 hours) or inside an enclosed garage. Inoperable vehicles (not moved for 48 hours) may be towed. Garage doors must stay closed except when entering/exiting.
- Modifications & architectural review: Interior modifications are allowed without approval, but any change visible from neighboring property (including exterior painting, antennas, window coverings) requires prior written board approval. The board may require a security deposit, insurance, and compliance with design guidelines.
- Assessments & fees: Common expenses are shared equally among all units. Initial assessments are 25% per unit but may adjust as future phases are added (up to 26 units). Special assessments, enforcement fines, and transfer fees may be levied. Nonpayment creates a lien on the unit.
- Use & occupancy restrictions: Units are for single-family residential use only. Home-based businesses are allowed only if not detectable from outside and with limited employee/visitor traffic. Time-sharing (occupancy for 30 consecutive days or less) is prohibited. No nuisances, hazardous materials, or unlawful activities.
- Variances: The board may grant variances from any declaration provision, subject to conditions (e.g., temporary/permanent, removal on sale). Variances do not waive the rule for others and cannot conflict with insurance policies.
