Bayfield Condominiums is a residential condominium community in Fountain Hills, Arizona—you own your individual unit's interior and are responsible for its upkeep, while the association maintains all shared building structures, grounds, and common areas. The declaration strictly limits use to residential occupancy by a single family, requires approval for most exterior changes, and imposes detailed rules on vehicles, pets, and leasing.
- What you own & maintain: You own everything within your unit's interior surfaces (walls, floors, ceilings, doors, windows) plus finished materials like flooring and paint. You must maintain your unit and any limited common elements (patios, balconies, exterior doors/windows) allocated to you, except for their structural parts; the association maintains and pays for all other shared common elements.
- Residential use only: Units must be used exclusively for residential occupancy by a single family—no business, trade, or gainful occupation. You may keep personal business records or handle business calls from your unit, but no commercial activity is permitted.
- Leasing & rentals: You may lease your entire unit (not partial leases) for a minimum of 30 days. Leases must be written, require tenants to comply with all condominium rules, and you must notify the association of lease start and end dates and the tenant's name.
- Pets: A maximum of two house pets (dogs, cats, or birds) per unit are allowed, each not exceeding 18 inches in height at the shoulder. Pets must be kept indoors or, if outside, on a leash no longer than 6 feet and under direct control; pet waste must be immediately removed from common areas.
- Parking & vehicles: No trucks, RVs, trailers, campers, or boats are permitted except for camper-shell trucks and mini-vans under 205 inches long and 80 inches wide used for regular transportation. No inoperable vehicles or motor vehicle repair work may be visible from neighboring properties, and no vehicles may park on private streets within the community; violations may result in towing at the owner's expense.
- Architectural review: Most alterations and improvements require written approval from the Architectural Committee before work begins. This includes non-structural changes visible from outside (exterior doors, windows, window coverings, drapes, blinds), antennas, utility lines, signs, trash containers, and landscaping. Structural alterations require both architectural committee approval and certification by a licensed Arizona architect or engineer.
- Assessments & voting: Common expenses (maintenance, insurance, repairs) are assessed equally across all units. Each unit owner receives one vote in association decisions, allocated equally among all units.
- Your liability: You are financially responsible for any damage to common elements or neighboring units caused by your negligence or willful conduct, and you must repair your unit and allocated limited common elements if you fail to maintain them within 30 days of written notice.
