What Crestview at Fountain Hills's governing documents say
Crestview at Fountain Hills is a planned residential community in Fountain Hills, Arizona, where you own an individual lot subject to architectural controls and deed restrictions. The association, governed by an elected board funded by annual lot-owner assessments, maintains common areas and enforces design standards and covenants binding all properties.
- What you own & maintain: You own your individual lot and must keep it clean, free of nuisances, and in good repair. The association maintains common areas (roads, walkways, landscaping, recreational facilities) funded by lot-owner assessments.
- Architectural review & approval: All exterior improvements—buildings, fences, patios, grading, landscaping, parking—require written approval before construction. During development, the Committee of Architecture reviews plans; after all lots are sold, the Board assumes this role.
- Annual assessments & fees: Assessments are divided equally per lot and may increase annually by up to 10% or the Consumer Price Index (West Region), whichever is higher. Special assessments for capital projects require a majority vote; owners who fail to maintain their lot after notice are billed for association repairs.
- Delinquency & liens: 30 or more days late on assessments incurs handling fees and interest (capped at 12% per annum or the prime rate plus 2%, whichever is greater). After 90 days, the association may record a lien and pursue foreclosure.
- Association governance & voting: A three-member board manages the association, collects assessments, and maintains $1 million liability insurance. During development, the developer has 10 votes per lot owned versus lot owners' 1 vote per lot; after all lots are sold, all owners have equal voting rights.
- Enforcement & conflict resolution: Violations of the Declaration are enforceable through legal action by the association, other lot owners, and successors. The board may impose fines or fees and establish liens; it may also arbitrate disputes between lot owners if both parties consent.
- Declaration term & amendments: The Declaration runs with the land for 25 years and automatically extends for successive 10-year periods unless owners vote to terminate. Amendments require separate majority approval from both voting classes.
