Desert View Condominiums is a condominium community in Fountain Hills, AZ, consisting of just two units (A and B). Each unit owner owns their individual unit and an undivided one-half interest in the common elements, with the association (the two owners jointly) maintaining common property. This declaration binds unit owners and sets rules for use, maintenance, and governance.
- What you own & maintain: You own the interior of your unit (walls, roof slab, interior partitions). Exterior features like porches, balconies, and windows are limited common elements allocated to your unit, but you must maintain them. The association maintains common elements, but if it fails, each owner must maintain the common area adjacent to their unit.
- Use restrictions: Units are for single-family residential use only. No business or trade allowed. No solar panels, satellite dishes, or antennas visible from neighboring property without the adjacent owner's written consent. No clotheslines, no vehicle repairs visible, no inoperable vehicles, no nuisances, and no exterior speakers (except security). All exterior alterations require approval of the adjacent unit owner.
- Assessments: Common expenses are shared equally (50/50). Assessments are based on an annual budget adopted by the board. Assessment liens are subordinate to first mortgages. Delinquent assessments may be reallocated as common expenses.
- Insurance: Each unit owner must carry fire, casualty, and liability insurance on their unit equivalent to full replacement value. Minimum combined liability coverage for both units is $500,000. Proof of insurance must be provided to the adjacent owner.
- Amendments & duration: The declaration runs for 20 years from recording (2006) and automatically renews for successive 10-year periods. Amendments require 100% of unit owner votes (both owners) or, during declarant control, may be made unilaterally by the declarant to comply with law. Certain amendments also require approval of first mortgagees holding 100% of unit votes.
- Architectural review: The association must establish an architectural committee (at least 2 members) to regulate exterior design. Additionally, the Fountain Hills Committee of Architecture has jurisdiction, and if rules conflict, the most restrictive applies.
- Disputes & enforcement: Disputes between unit owners must go through a 21-day negotiation period, then binding arbitration by an arbitrator selected from the Maricopa County Superior Court if they cannot agree. The prevailing party in any enforcement action is entitled to attorney's fees.
