Arroyo Sundown is a 2-unit condominium community in Fountain Hills, AZ — you own your individual unit and share ownership of the building's common elements, which the association maintains and insures, funded by per-unit assessments. This document is the full condominium declaration, binding all unit owners.
- What you own & maintain: You own the interior finished surfaces of your unit (walls, floors, ceiling finishes) and are responsible for all maintenance and repairs inside your unit. The association maintains the common elements (structures, grounds) and the structural parts of limited common elements like patios and balconies.
- Pets: Only unit owners may have pets — no pets allowed for lessees or guests. A single household pet under 20 pounds is permitted, must be registered with the association, kept on a leash no longer than 6 feet when outside the unit, and owners must immediately remove droppings. No pet structures visible from outside.
- Leasing & rentals: You may only lease your entire unit (not a room), and the lease must be in writing and state that it is subject to the condominium documents. The tenant must comply with all rules. You must notify the association of the lease start and end dates and the tenant's names. The lease term is not restricted by this document, but no less than entire unit leasing is allowed.
- Architectural review: Any structural additions or alterations inside your unit, and any exterior changes (visible from outside), require prior written approval from the Architectural Committee. Nonstructural interior changes do not need approval. An architect or engineer must certify structural changes.
- Parking & vehicles: No commercial vehicles (over 3/4 ton capacity) or boats/trailers are allowed except temporarily. No inoperable vehicles visible from neighboring property. Parking is only in designated spaces; the board can regulate parking and tow violators at the owner's expense.
- Assessments & fees: Each unit pays an equal share of common expenses. The initial maximum annual assessment was $1,200 per unit, adjustable annually by CPI. A working capital fund equal to 1/6 of the annual assessment is due from first purchasers. Delinquent assessments accrue 12% interest and a $10 late fee, and the association can foreclose its lien.
- Use restrictions: Units must be used as single-family residences only. No business, trade, or commercial activity is allowed (except personal professional library or home office). No nuisances, offensive activity, or unlawful use. No clotheslines, outdoor furniture without approval, or high-intensity lighting directed at others.
- Signs & exterior appearance: No signs are permitted on the exterior of any unit or building, including 'For Sale' or 'For Rent' signs, except the association may place signs. Window coverings must be approved by the Architectural Committee to maintain a uniform exterior appearance.
