What Cardinal Corner Condominiums's governing documents say
Cardinal Corner Condominiums is a two-unit condominium community in Fountain Hills, AZ — you own your individual unit and share ownership of the building's common elements. The declaration governs use, maintenance, assessments, and leasing, and is binding on all unit owners.
- Use restrictions: Units must be used as a single-family residence only. No business, professional office, or gainful occupation is allowed inside a unit, though personal business calls or correspondence from home are permitted.
- Pets: Only one household pet weighing no more than 20 pounds is allowed per unit, and only unit owners (not tenants or guests) may keep a pet. Dogs must be leashed (max 6 feet) when outside the unit, and owners must immediately clean up droppings. Pets must be inoculated and registered with the association.
- Leasing: A unit owner may lease only the entire unit (not a portion). All leases must be in writing and include a provision that the lease is subject to the condominium documents. The owner must notify the association of the lease start and end dates and tenant names. No minimum lease term is stated in this declaration.
- Parking & vehicles: Vehicles must be parked only in designated spaces. No commercial vehicles, buses, vans, or trucks over 3/4 ton carrying capacity may be parked without board approval, except for temporary parking of invitees and service vehicles. Inoperable vehicles may not be stored, and the association may tow violating vehicles at the owner's expense.
- Architectural review: Any structural additions, alterations, or improvements within a unit require prior written approval from the Architectural Committee and a licensed Arizona engineer's certification that the work won't impair structural integrity. Nonstructural interior changes do not require approval, but any exterior-visible changes (including window coverings, solar devices, satellite dishes, and outdoor lighting) must be approved.
- Assessments: Each unit is assessed equally (1/2 of total common expenses). The initial maximum annual assessment was $1,800 per unit, adjustable annually based on CPI. Special assessments for capital improvements require a 2/3 vote of unit owners. Delinquent assessments accrue 12% annual interest and a $10 late fee, secured by a lien on the unit.
- Maintenance responsibilities: The association maintains and repairs all common elements (including structural parts). Unit owners are responsible for maintaining their unit's interior and any limited common elements allocated to their unit (e.g., patios, balconies, and exclusive-use utility lines). Owners must keep limited common elements clean and free of weeds and trash.
- Insurance: The association must carry property insurance on the units and common elements (replacement cost, all-risk form) and general liability insurance of at least $1,000,000 per occurrence. Unit owners may obtain their own insurance for personal property and liability. The association also maintains fidelity bonds covering officers, directors, and employees handling funds.
