Costa Alada Condominiums is a small condominium community in Fountain Hills, AZ, consisting of two units (A and B). You own your individual unit and share ownership of the common elements with the other unit owner. This declaration governs the use, maintenance, and administration of the property.
- Residential use & occupancy: Each unit must be used exclusively as a single-family residence. No business, trade, or nonresidential use is allowed, though owners may keep a personal professional library or handle business calls from their unit.
- Exterior alterations & architecture: Any structural changes or exterior modifications (including color or texture changes) require prior written approval from the owner of the adjoining unit. Solar panels, satellite dishes, and external antennas are prohibited if visible from neighboring property without similar consent.
- Assessments & common expenses: Common expenses are allocated equally between the two units. Each unit has one vote in the association. Assessments are set by the board's budget and are subordinate to first mortgage liens.
- Maintenance responsibilities: The association maintains common elements and performs duties determined by unit owners. Each unit owner maintains their own unit and their allocated limited common elements. If the association fails to maintain common elements, owners must maintain the portion contiguous to their unit divided approximately in half.
- Insurance requirements: Each unit owner must maintain fire, casualty, and liability insurance on their unit at full replacement value, with at least $500,000 combined liability coverage. Proof of insurance must be provided to the adjoining unit owner.
- Dispute resolution: Disputes between unit owners must first be resolved through a 21-day negotiation period. If unresolved, the matter goes to binding arbitration, with an arbitrator selected by mutual agreement or by the Maricopa County Superior Court. The decision is binding and must be complied with within 30 days.
