Fairfax Two is a 2-unit condominium in Fountain Hills, AZ. You own your individual unit and an undivided one-half interest in the common elements. The association maintains the shared building and grounds, and sets rules that all owners and occupants must follow.
- What you own & maintain: You own the interior of your unit (walls, floors, ceilings, fixtures) and are responsible for its maintenance, including plumbing and electrical within the unit. The association maintains all common elements, including structural components, exterior walls, and landscaping. Patios, balconies, driveways, and entryways are limited common elements—you have exclusive use but the association may maintain them as a common expense.
- Leasing & rentals: You may lease your unit, but the lease must be in writing (month-to-month is allowed) and must state that the tenant must follow the declaration and rules. As the owner, you are responsible for ensuring tenant compliance; if you fail to act, the association can enforce the lease terms on your behalf.
- Pets: You may keep up to two household pets (dogs, cats, etc.) in your unit, but the total weight of all pets in the unit cannot exceed 70 pounds. No breeding or commercial purposes allowed. Pets must be leashed when outside your unit.
- Parking & vehicles: Parking is limited to inside your attached garage. Temporary parking for guests, deliveries, and loading is allowed in designated areas, but no overnight parking in driveways except for visitors (max two consecutive nights). Recreational vehicles, boats, trailers, and commercial trucks may not be parked on the property (except inside the garage) without board approval.
- Assessments & fees: All units pay equal regular assessments, billed monthly. The association can also levy capital improvement assessments (up to 10% of annual budget without 100% owner approval) and special assessments for violations or repairs. At closing, each new owner pays a one-time working capital fund equal to two months’ regular assessments.
- Use restrictions & appearance: Units are for private residential use only; no businesses. No signs (except a small name/address sign), no external fixtures (like solar panels, satellite dishes, awnings, fences) without board approval. Window coverings visible from outside must be neutral-colored. No noisy activities or nuisances. No oil or mineral operations. Repairs of vehicles or machinery on the property are prohibited.
