What Ridgeview Casitas's governing documents say
Ridgeview Casitas is a 9-unit condominium in Fountain Hills, AZ — you own your unit's interior airspace and a private garage and yard, plus an undivided one-ninth share of the common elements. The association maintains the building's exterior, common areas, and carries master insurance, funded by per-unit assessments. This is the full declaration governing all owners and residents.
- What you own & maintain: You own the interior airspace of your unit, including appliances, plus the exclusive use of an attached garage and a private yard. The association owns and maintains all bearing walls, roofs, foundations, common elements, and exterior landscaping. You are responsible for doors, windows, HVAC, and your own patio/yard.
- Permitted use & occupancy: Units are restricted to 'Single Family' use — defined as persons related by blood, marriage, or adoption, or a group of no more than four unrelated persons living together as a household. No business, trade, or commercial activity is allowed.
- Leasing & rentals: The declaration allows leasing to a single family but does not specify a minimum lease term. Only the entire unit may be rented, not a portion. The owner (not tenant) is responsible for all assessments and rule compliance.
- Pets: Cats, dogs, birds, and other household pets are permitted, but the board may set rules and require prior written consent. Owners must prevent pets from defecating or urinating outside their own yard or patio.
- Architectural review: Any exterior alteration, improvement, fence, or change in color or materials requires prior written board approval. However, patio or yard improvements that are not visible from neighboring property do not need approval.
- Parking & vehicles: No mobile homes, boats, RVs, trailers, or trucks may be kept visible from neighboring property for more than 24 consecutive hours or 48 hours total in a week. Automobiles may not be parked on streets or common-area drives without board approval.
- Assessments & fees: Annual assessments start at a maximum of $900 per unit, adjustable by CPI. Special assessments for capital improvements require a two-thirds vote of owners. Delinquent assessments become a lien on the unit.
- Common Walls: Owners sharing a common wall have equal rights to use it, but must not impair structural integrity. Damage caused by an owner must be repaired at that owner's cost; ordinary wear and tear is the association's responsibility.
