What Bjb Casa Properties's governing documents say
BJB Casa Properties is a 2-unit condominium community in Fountain Hills, AZ. Each unit owner has exclusive ownership of their unit and shared interest in common elements. The declaration governs use, maintenance, and neighbor cooperation, with an emphasis on adjacent unit owner approvals.
- What you own & maintain: Each unit owner maintains their unit and limited common elements (e.g., balconies, porch, exclusive utility meters). The association maintains common elements, but if it fails, each owner must maintain the common area contiguous to their unit.
- Use restrictions: Units are for single-family residential use only. No business, no solar panels or antennas visible from neighboring property without written consent of the adjacent unit owner. No outside clotheslines, no inoperable vehicles visible, no nuisances.
- Architectural review: An architectural committee appointed by the board regulates external design. Additionally, the Fountain Hills Committee of Architecture has jurisdiction. Structural changes or exterior modifications require prior written approval of the adjacent unit owner.
- Insurance: Each unit owner must maintain fire, casualty, and liability insurance on their unit at full replacement value, plus at least $500,000 in liability coverage jointly with the adjacent unit owner.
- Assessments: Common expenses are assessed equally between the two units. Assessment liens are subordinate to first mortgages. Delinquent amounts may be reallocated as common expenses after a foreclosure.
- Dispute resolution: Disputes between unit owners must first be resolved through a 21-day notice period. If unresolved, the matter goes to binding arbitration (by mutual choice or court-appointed).
- Amendment & duration: The declaration runs for 20 years from recording and auto-renews for 10-year periods. Amendments require 100% vote of unit owners; certain changes need unanimous consent. Declarant retains amendment rights during the period of declarant control.
- Rights of lenders: First mortgagees have rights to notice, inspection, and to approve major changes (e.g., termination, boundary changes). The declaration prohibits any right of first refusal.
