What Four Tops Condominiums I's governing documents say
Four Tops Condominiums I is a small condominium community in Fountain Hills, AZ — initially just two units (A and B), but the developer can add up to 48 units. You own your individual unit and share ownership of common elements; the association maintains the common areas and carries master insurance funded by assessments. This declaration lays out the rights and restrictions for unit owners, including use rules, pet limits, leasing requirements, and architectural controls.
- What you own & maintain: You own the interior of your unit (walls, floors, finishes). The association maintains all common elements (roof, exterior, grounds). You are responsible for maintaining your unit and any limited common elements like patios or balconies assigned to your unit.
- Pets: Only one house pet (dog or cat) per unit, weighing no more than 20 pounds. No other animals, birds, or livestock allowed. Pets must be registered with the association, kept on a leash (max 6 feet) when outdoors, and cleaned up after. No pet structures visible from outside.
- Leasing & rentals: You may lease your entire unit (not just a room) under a written lease that acknowledges the condominium documents. You must notify the association of the lease start and end dates and tenant names. No lease for less than the whole unit; no minimum lease term stated.
- Architectural review: Any structural change inside your unit, or any visible exterior alteration (including window coverings, satellite dishes, solar panels, signs, or outdoor lighting), requires prior written approval from the Architectural Committee. Nonstructural interior changes do not need approval.
- Parking & vehicles: No commercial vehicles, boats, trailers, or inoperable vehicles may be parked on the property except for temporary loading/unloading. The board can regulate parking and tow violators at the owner's expense.
- Assessments & fees: Each unit pays an equal share of common expenses. The maximum annual assessment initially is $300 per unit, adjustable by CPI without a vote. Special assessments require a 2/3 vote of owners. Delinquent assessments accrue 12% interest and late fees; the association can foreclose.
- Use & occupancy restrictions: Units are for single-family residential use only. No home businesses, no nuisances, no outside speakers, no clotheslines visible. All occupants must follow state and local laws.
