What De’ja’ View on the Ave. Condominiums's governing documents say
De’Ja’ View On The Ave. Condominiums is a condominium community in Fountain Hills, AZ — you own your individual unit and share ownership of the building's common elements. This declaration governs the two-unit condominium. Units are restricted to professional office use only; no residential occupancy is allowed. The association maintains the common elements (excluding parking areas) and carries master insurance, funded by assessments allocated equally (50% per unit).
- Permitted use (office only): All units must be used exclusively for general professional office purposes (e.g., architects, accountants, lawyers, medical/dental offices). Residential use is strictly prohibited. Any other use requires unanimous unit owner approval.
- What you own & maintain: You own the interior finished surfaces of your unit (walls, floors, ceilings) and are responsible for its maintenance and repair. Limited common elements (e.g., patios, balconies, exterior doors, certain utility meters) are also your responsibility. The association maintains all common elements except limited common elements.
- Alterations & architectural review: Nonstructural alterations within your unit do not require prior approval, but structural alterations or any change visible from the exterior need written approval from the Architectural Committee. If visible from an adjoining unit, that unit owner's approval is also required.
- Signs & exterior appearance: No signs, banners, or lettering visible from outside your unit may be erected without association consent. Signs on entrance doors or in corridors must conform to association rules. Interior decor visible from outside must be neutral and consistent with the building's theme.
- Motor vehicles & parking: No vehicle repair (except emergencies) or storage of inoperable vehicles is permitted if visible from neighboring property. Parking areas are not common elements; no parking easements are granted.
- Assessments & fees: Common expense assessments are levied per unit (50% each). Special assessments require approval by two-thirds of unit owners. Late payments incur 12% annual interest and a $10 late fee. A working capital fund is paid by purchasers (one-sixth of annual assessment).
