Alberta Condos is a 2-unit condominium in Fountain Hills, AZ. You own your individual unit and share ownership of common elements (allocated equally), which the association maintains. As a unit owner, you're responsible for maintaining your unit, your exclusive yard/patio, and complying with detailed restrictions on alterations, use, and appearance.
- What you own & maintain: You own your individual unit interior; the association maintains shared structures and grounds. Each unit receives equal interests in common elements and one vote in association decisions. You're responsible for your unit interior and your exclusive yard and patio shown on the plat.
- Residential use only: Units must be used exclusively for single-family residential occupancy; no business, trade, or gainful occupation is permitted. You may maintain a personal professional library, keep personal business records or accounts, or handle personal business calls or correspondence in your unit.
- Alterations & modifications: Non-structural interior changes don't require approval, but you're liable for any resulting damage. Any structural additions, alterations, or changes to exterior color/texture require written approval from the adjacent unit owner before work begins.
- Exterior appearance restrictions: Outside clotheslines are prohibited. Motor vehicles cannot be visibly constructed, serviced, or repaired on the property; inoperable vehicles cannot be visibly stored or parked. Solar devices, satellite dishes, antennas, or similar collection devices visible from neighboring property require written consent from the adjacent unit owner.
- Insurance requirements: You must maintain fire and casualty insurance on your unit at full replacement value with an insurer rated B+ or better by Best's Insurance Ratings.
- Assessments & liens: Assessments are allocated equally among the 2 units. Assessment liens are subordinate to first mortgages; foreclosure or deed-in-lieu eliminates the delinquent owner's assessment debt, but the cost is reallocated to remaining units as a common expense.
- Dispute resolution: A unit owner must serve written notice of a violation; the owners then have 21 days to settle the dispute. If unresolved, arbitration follows before a board selected by the Maricopa County Superior Court judge, with binding decisions due for compliance within 30 days.
- Subject to Fountain Hills architectural restrictions: The condominium is subject to the Fountain Hills Committee of Architecture; if the Fountain Hills Committee's rules conflict with this condominium's architectural committee rules, the more restrictive rules apply. Owners may face two layers of architectural review and approval.
