The Residences on Chama Condominiums is a 2-unit condominium in Fountain Hills, Arizona — you own your individual unit's interior and exterior, have exclusive use of your yard and patio, and share ownership of the building structure. The homeowners association manages the common elements and charges assessments equally between the two units.
- What you own & maintain: You own your unit's interior, exterior surfaces (walls, roof, doors, windows), and have exclusive use of the yard and patio assigned to your unit. The association maintains the shared building structure, common utilities, and shared grounds; you're responsible for maintaining your allocated limited common elements (yard, patio, utility meters serving only your unit).
- Maintenance & liability: You must maintain and repair all parts of your unit at your own expense. If the association fails to maintain common elements, you become responsible for the common elements contiguous to your unit. You're liable to the adjacent unit owner and the association for any damage caused by your negligence or willful conduct.
- Insurance requirements: You must maintain fire, casualty, and liability insurance on your unit at full replacement value, with an insurer rated B+ or better. Minimum joint liability coverage is $500,000 (you and the adjacent unit owner combined). You must provide proof of insurance to the other unit owner; the association may enforce these requirements.
- Use restrictions: Single-family residential use only — no business, trade, or gainful occupation (though you may keep personal professional records or take calls). No outside clotheslines, no visible vehicle repair or storage of inoperable vehicles, and no mineral exploration. You must comply with all Fountain Hills zoning laws and regulations.
- Architectural changes & approval: Non-structural interior additions or alterations don't require approval. Any structural changes, or changes to the exterior color/texture or roof, require prior written approval of the adjacent unit owner. You're liable for any damage resulting from alterations. All external design and appearance is also subject to the Fountain Hills Committee of Architecture; the more restrictive rules apply if there's a conflict.
- Assessments: The association assesses common expenses equally between the two units — each unit pays the same share regardless of size. Assessment liens are subordinate to mortgages, so foreclosure on a mortgage may wipe out unpaid assessments, which are then reallocated to the remaining unit owner.
- Governance & amendments: During the initial 90-day period after the declarant conveys 100% of units, the declarant appoints the board. After that, unit owners elect at least two unit-owner directors. Any amendment to the declaration requires approval from First Mortgagees and/or 100% of unit owners (or lesser percentages for minor clarifications). Each unit has one vote in the association.
