What Desert Sage Condominiums's governing documents say
Desert Sage Condominiums is a condominium community in Fountain Hills, AZ. You own your unit's interior and share ownership of the common elements, which the association maintains and insures. This declaration sets the rules for unit owners, covering use, leasing, pets, parking, and assessments.
- What you own & maintain: You own the interior surfaces and fixtures serving only your unit. The association maintains and insures all common elements, including the building exterior, roof (except the portion above your unit, which you must maintain), and shared spaces. You are responsible for your unit, any limited common elements allocated to you, and the roof portion above your unit.
- Pets: Up to two commonly accepted household pets per unit are allowed without board approval. Additional pets require board approval. No commercial breeding or animals that become a nuisance. Pets must be leashed on common elements.
- Leasing & rentals: You may lease only your entire unit, not a portion. All leases must be in writing, subject to the declaration and rules, and no subleasing or assignments are allowed. You must provide the association with lease details at least 10 days before the lease starts. You are liable for any rule violations by your tenant or their guests.
- Parking & vehicles: No trucks, trailers, campers, boats, or inoperable vehicles may be parked on the property. Parking is only in designated spaces. No vehicle repairs except for emergencies. The association may tow violators at the owner's expense.
- Use restrictions: Units are for single-family residential use only. No business or professional use is allowed, except personal professional activities like a home office. No exterior antennas or signs without board approval. You must comply with all laws and not create nuisances.
- Assessments & fees: You must pay a monthly common expense assessment, calculated equally among units. Special assessments (e.g., for capital improvements) require approval by two-thirds of voting unit owners. Late payments incur interest and fees, and unpaid assessments become a lien on your unit. A transfer fee is charged when you sell.
- Alterations & improvements: You may make nonstructural interior changes without approval. Structural changes or any exterior changes (visible from outside) require prior written approval from the board. You are responsible for any damage caused by your alterations.
