Castiglia-Kearns Duplex is a two-unit condominium in Fountain Hills, AZ — you own your individual unit and share ownership of the building's common elements. The document governs the rights and responsibilities of the two unit owners, with many decisions requiring mutual consent between the adjacent owners. It is designed for single-family residential use only.
- What you own & maintain: Your unit's interior (within finished surfaces of exterior walls, slab, and roof) is your responsibility. Limited common elements like patios, meters, and fixtures serving only your unit are also your maintenance responsibility. The association maintains the common elements, but if it fails, each owner must maintain the half of common elements contiguous to their unit.
- Use restrictions: Each unit may only be occupied by a single family. No business, profession, or trade is allowed (except personal professional library or business calls). No solar collectors, satellite dishes, or exterior antennas are allowed without the adjacent owner's written consent. Clotheslines, vehicle repairs visible from neighboring property, inoperable vehicles, and nuisances are prohibited.
- Architectural changes & adjacent owner approval: Nonstructural interior alterations don't need approval. Any structural change or modification to the exterior (including color/texture) requires the prior written approval of the owner of the adjacent unit. The adjacent owner also must approve any solar or antenna devices.
- Assessments & expenses: Common expenses are allocated equally between the two units (each 50%). The board adopts a budget and may levy assessments accordingly. Any assessment lien is subordinate to first mortgages.
- Insurance requirements: Each unit owner must maintain fire, casualty, and liability insurance with full replacement value and at least $500,000 combined liability coverage (shared with the adjacent owner). Proof of insurance must be provided to the adjacent owner.
- Dispute resolution between owners: If a dispute arises between unit owners, the complaining owner must give written notice and allow 21 days to settle. If unresolved, the dispute goes to binding arbitration (either by agreed arbitrator or American Arbitration Association), with compliance required within 30 days.
- Duration & amendment: The declaration runs for 20 years from recording (2005) and automatically renews for 10-year periods. Amendments require 100% of unit owner votes (both units must agree), except for certain declarant rights during the period of declarant control.
