The association (HOA) maintains common elements and enforces rules, but each owner must maintain their own unit and limited common elements.
- Use restrictions (residential only): Each unit must be used exclusively as a single-family residence by one household. No business, profession, or trade is allowed on the premises, though you may keep a personal library or handle personal business calls.
- External alterations & design (architectural review): Any exterior changes (including solar devices, satellite dishes, antennas, or structural alterations) require prior written approval from the Architectural Committee and the Board. Nonstructural interior changes do not need approval but you must pay for any damage to adjacent units or common elements.
- Maintenance responsibilities: The association maintains the common elements (e.g., shared structures, landscaping). You must maintain your unit and the limited common elements assigned to you (yard, patio, garage, driveway). If your negligence damages common elements or another unit, you pay the cost.
- Insurance requirements: Each unit owner must carry fire, casualty, and liability insurance on their unit with at least $500,000 liability coverage (or a higher amount if the association requires). Proof must be given to the adjacent unit owner.
- Assessments: The association may levy common expense assessments equally between the two units (50% each). Special assessments may also be imposed. Any assessment lien is subordinate to first mortgages.
