What Agritopia's governing documents say
This is a Tract Declaration, an ancillary document that supplements the main Declaration for the Agritopia master-planned community in Gilbert, AZ. It applies only to a specific parcel (the Surrey Garden School site) and restricts that parcel to school/educational use (grades K-12) with limited religious activities. It does not set general rules for all Agritopia homeowners, buyers, or renters; it is a supplemental restriction on a single parcel.
- Use restrictions: The parcel may be used only as a school for grades kindergarten through 12. Religious activities or education are allowed only in the evenings or weekends when school is not in session. Athletic, fundraising, and similar activities are not precluded.
- Architectural review & improvements: No structures or improvements may be built without the prior written consent of Declarant (Johnston Farms, LLC). Plans and specifications, including architectural designs, must be submitted for approval in Declarant's sole discretion. Exterior lights that could constitute a nuisance to neighbors are prohibited.
- Insurance requirements: Before using the parcel or starting construction, the parcel owner must maintain commercial general liability insurance with a combined single limit of at least $1,000,000 per occurrence, $3,000,000 general aggregate, plus $3,000,000 umbrella excess liability. Declarant must be named as an additional insured, and policies cannot be cancelled without 30 days' written notice.
- First right of refusal: Declarant has a first right of refusal for 30 years from the date of this document (2002). If the parcel owner wants to sell, lease, or transfer the parcel, they must first offer it to Declarant on the same terms. Declarant has 10 business days to accept or decline; if declined or unanswered, the owner may proceed with a third party on those terms.
- Easements: Declarant reserves a drainage easement over the parcel and an easement for any retention or detention basins on the parcel.
- Organic farm awareness: The parcel owner must inform all staff, faculty, students, parents, guests, and visitors about the purposes and possible nuisances of organic farming and agricultural operations in Agritopia, and must not oppose or jeopardize any organic certification.
- Reimbursement obligations: If a turn-circle is constructed at the intersection of Agritopia Loop and Promenade Lane by a third party or Declarant, the parcel owner must reimburse its pro-rata share within 10 days of written request. This obligation is secured by an assessment lien under the main Declaration.
- What this document doesn't cover: This document does not contain general community rules for Agritopia residents (e.g., pet limits, leasing restrictions, parking, maintenance obligations for individual homes). Those are governed by the main Declaration, which is not included here. This Tract Declaration only applies to the specific school parcel.
