What Higley Park Commons's governing documents say
Higley Park Commons is a condominium in Phoenix, AZ, where units are intended for professional, medical, veterinarian, or business offices — not residential use. You own your unit and share the common elements. The declaration governs use, leasing, alterations, parking, and other restrictions.
- Permitted uses: Units may only be used as professional, medical, veterinarian, or business offices, in compliance with Maricopa County zoning. Medical office waste must be disposed of legally. Any other use requires approval by the Declarant or Board (during Declarant control) or all unit owners (after control terminates).
- Leasing & rentals: Leases must be in writing and require the lessee to comply with the declaration and rules. The unit owner must notify the association at least 10 days before the lease starts, providing dates, lessee names, owner contact info, and emergency contact. The owner is liable for any violations by lessees or guests.
- Alterations & improvements: Nonstructural interior changes generally do not need Board approval, but changes to perimeter walls, party walls, or anything visible from outside require written Board approval. Structural changes require Board approval plus an architect/engineer certification. The Board may impose conditions, such as insurance and security deposits.
- Parking & vehicles: Vehicles may only be parked in designated parking spaces (allocated as limited common elements). No trucks, trailers, campers, boats, or inoperable vehicles. No repairs except emergencies. Employee parking is restricted; employees must use parking spaces allocated to the unit or perimeter spaces.
- Signs & window coverings: Exterior signs require prior written Board approval (not to be unreasonably withheld). The Board may set criteria for size, location, and style. Reflective window materials and any window coverings affecting exterior appearance need Board approval.
- What you own & maintain: You own your unit (interior spaces, interior partitions, and fixtures serving only your unit). The association maintains common elements and perimeter building walls. You are responsible for maintaining your unit and any limited common elements allocated to your unit (e.g., pipes, ducts serving only your unit).
- Animals: No animals, birds, or reptiles are allowed except fish in aquariums and animals kept by a veterinarian as part of their practice.
