What City Gate's governing documents say
City Gate is a master-planned development in Gilbert, Arizona comprising multiple parcels for various uses, governed by the City Gate Association. Property owners own individual parcels and share extensive easement rights for access, parking, utilities, and drainage across the development, while the Association maintains common areas and must approve all construction.
- What you own & maintain: You own a Parcel (land and any buildings/improvements on it) and are responsible for maintaining it according to Association standards. The Association maintains the Access Drives (private streets in Tract A), common landscaping, and infrastructure including utilities and drainage systems.
- Architectural review & construction approval: Before constructing any building, exterior alteration, or major improvement on your Parcel, you must submit preliminary plans to the Board for approval. Plans must conform to Developmental Guidelines and cover buildings, grading, drainage, colors, materials, signage, parking, lighting, and landscaping; the Board has 30 days to respond (plans are deemed approved if no response within 30 days).
- Parking & vehicles: All vehicle parking must occur in designated areas per marked striping. The Association can fine or tow violating vehicles. Employees of Parcel owners must park on the Parcel where they work, not on shared common areas or other owners' properties.
- Easements & shared access rights: All owners have perpetual, nonexclusive easement rights across shared areas for vehicular and pedestrian access, parking, utility installation and maintenance, storm water drainage, and emergency maintenance access. These easements cannot be obstructed or blocked by fences, barriers, or improvements.
- Community governance & voting: The City Gate Association, governed by a Board of Directors, manages the development. Each Parcel receives a minimum of 4 votes, plus 1 additional vote per 4 acres (or portion thereof). The Declarant (initial developer) appoints the Board while holding any Parcel; subsequent Boards are elected by Owners.
- Assessments & payment obligations: Owners must pay Annual, Special, and Individual Assessments to cover common area maintenance and operation. Non-payment for 15+ days results in loss of voting rights and allows the Association to place an assessment lien on the Parcel.
- Restricted access areas: Owners may request the Association designate portions of their Parcel as Restricted Access Areas for exclusive use (Lots 18 and 19 are currently designated this way). Owners of restricted areas must post public notice signs.
