Folkman Ranch Estates is a single-family home subdivision in Gilbert, AZ, governed by a Declaration of Covenants, Conditions, and Restrictions (CC&Rs). The rules bind all lot owners and are enforced by an Architectural and Landscaping Control Committee. This document outlines what you can build, how you can use your property, and the assessments you must pay.
- Use & buildings: Lots are for single-family residential use only. No trailers, tents, or temporary buildings allowed. Structures can't exceed two stories. Setbacks: front 40 ft, sides at least 20 ft (or 10% of lot width), rear 40 ft. No building outside the building envelope on Lots 16-18, and no fence south of the sewer easement on Lots 1-6.
- Architectural review: Any new building, fence, wall, or landscaping change—including repainting in a different color—must be approved in writing by the Committee. The Committee has broad discretion over design, materials, and location. Two sets of plans must be submitted.
- Parking & vehicles: No boats, campers, horse trailers, or inoperable vehicles may be parked on any lot or road, except briefly while moving into a garage. No major vehicle repairs outside a garage. Signs: only one 'For Sale' or 'For Rent' sign up to 3 sq ft.
- Assessments & liens: The Committee can levy annual assessments (equal per improved lot, half for unimproved lots) and special assessments. Unpaid assessments become a personal debt and a lien on the lot, which can be foreclosed. Delinquent assessments accrue interest at the maximum legal rate.
- Pets: Only a reasonable number of domestic household pets allowed. No livestock, poultry, or commercial breeding. Pets must not be a nuisance. The Committee decides what is 'reasonable' and may deem an animal a nuisance.
- Maintenance & landscaping: Owners must keep their lot and structures in good repair, including painting, shrubs, and grass. No trash accumulation; garbage must be removed. The Committee can enter a lot to enforce maintenance and lien the lot for costs.
- Duration & amendments: These restrictions run with the land for 20 years from 1987, automatically renewing every 10 years. Amendments require approval of 75% of lot owners and must be recorded.
