What The Gardens III Condominiums's governing documents say
The Gardens III Condominiums is a 50-unit condominium community in Phoenix, Arizona, governed by a three-member board of directors. Unit owners own their individual units and share ownership of the common building elements (structure, grounds, recreational facilities), which the association maintains and insures through per-unit assessments.
- What you own & maintain: You own the interior space of your unit (bounded by perimeter walls, doors, ceilings, windows, and floors) and hold an undivided fractional interest in all common elements, including the building's structural components, grounds, storage, recreational facilities, and utilities. Bearing walls, columns, floors, roofs, and foundations are not part of your unit.
- Assessments & payment obligations: Unit owners must pay annual and special assessments set by the board at least 30 days in advance. If not paid within 30 days after the due date, the assessment accrues 12% annual interest (retroactive to the delinquency date), and the association may foreclose on your unit or sue you personally. You cannot escape liability by failing to use common areas.
- Damage & insurance recovery: The association carries hazard insurance on common elements and must repair damage using insurance proceeds. If proceeds fall short, the association can bill the responsible unit owner for the remainder; you must reimburse within 30 days or the association may pursue legal action.
- Governance & member voting: Unit owners elect a three-member board of directors in staggered three-year terms at an annual meeting held at 7:00 p.m. each year. Members may vote in person or by proxy. Quorum is one-tenth of all membership votes. The board meets monthly to manage operations.
- Assessment liens & property sales: Assessment liens on your unit are subordinate to (lower priority than) any first mortgage. If your unit is sold or foreclosed, liens for assessments due before the sale are extinguished, but you remain liable for all assessments due after the sale. Unit transfers do not eliminate the assessment lien.
- Suspension of rights for non-payment or violations: The board may suspend voting rights and recreational facility access for owners in default on assessments. For violations of published rules and regulations, the board may suspend privileges for up to 60 days after notice and a hearing.
- What this document doesn't cover: This by-laws document establishes governance and assessment procedures. It does not contain specific house rules, lease/rental restrictions, pet policies, parking rules, age restrictions, monthly assessment amounts, or detailed architectural guidelines—those are found in the Declaration, Rules & Regulations, and Architectural Control Committee guidelines.
