What Recker Pointe's governing documents say
Recker Pointe is a single-family home planned community in Gilbert, AZ, governed by a homeowners association (HOA). You own your lot and home, and the Association maintains common areas and enforces rules through assessments, design review, and use restrictions. This document is the Declaration of Covenants, Conditions, Restrictions and Easements (CC&Rs) that binds all owners and occupants.
- Architectural review: All exterior changes—including construction, landscaping, painting, and fences—require prior written approval from the Reviewing Authority (Declarant or the Design Review Committee). The Design Review Guidelines interpret these rules, and the Committee can grant variances.
- Assessments & fees: The Association levies Regular Assessments (annual), Special Assessments, Benefited Assessments, and one-time Working Capital and Reserve Fund Assessments (each capped at 1/6 of the annual Regular Assessment). Fees are secured by a lien on the lot.
- Use restrictions: The initial Use Restrictions are defined in Exhibit B (not included in this excerpt). They can be amended by Declarant during the Declarant Control Period, and later by the Board subject to a 67% member vote. Single-family use is defined as related persons or up to three unrelated persons.
- Maintenance: The Association maintains Common Area, perimeter walls (exterior surfaces), wrought-iron view fencing, and Driveway Easement improvements. Owners maintain their lots, interior walls, landscaping, and party walls (shared walls/fences between lots).
- Party walls & easements: Owners of contiguous lots share party walls; repair costs are divided if damage isn't willful. The document also establishes easements for driveways (PDE Lots), utilities, cross-drainage, encroachments, and public service access.
- What this document doesn't cover: This excerpt does not include the full Use Restrictions (Exhibit B) or any Association Rules, which may contain specific rules on pets, parking, leasing, and other conduct. Those documents are incorporated by reference and should be reviewed separately.
