Ashley Heights is a single-family home HOA in Gilbert, AZ. You own your lot and detached house; the association maintains common areas (tracts, landscaping, etc.). All owners are members and must pay annual assessments, and the association can fine for rule violations. The declaration covers use restrictions, architectural control, parking rules, and more.
- Residential use & home businesses: All lots must be used only for single-family residential purposes. No commercial activity is allowed, but home businesses are expressly permitted on residential districts.
- Leasing & rentals: Leases must be in writing, for an entire residence and lot, and have a minimum term of 30 days.
- Pets: Dogs, cats, and other common household pets are allowed, but types and breeds are limited to those the Board deems acceptable, and they cannot be kept in unreasonable numbers or cause a nuisance.
- Parking & vehicles: Vehicles must be parked in garages or driveways; no overnight on-street parking. Motor vehicles cannot exceed 222 inches in length, 75 inches in height, and 84 inches in width. Trucks, RVs, boats, and commercial vehicles cannot be visible from neighboring property unless parked in an approved storage area. Inoperable vehicles are prohibited.
- Architectural review: Prior written approval from the Architectural Committee is required for any exterior changes, including landscaping, paint, structures, and additions. The committee must respond within 60 days after receiving complete plans.
- Assessments & fees: Annual assessments are levied equally per lot. The maximum annual assessment started at $34 per lot and increases automatically by the greater of 10% or the CPI increase (but not more than 20% year-to-year without owner approval). A transfer fee and a one-time reserve payment equal to 2 months of assessments are due from the first purchaser of a new home.
- Fines & enforcement: The Association can impose fines for violations after a written warning giving at least 10 days to correct, and fines become a lien on the lot if unpaid. Delinquent assessments also become a lien, and the Association can foreclose.
- Party walls: Walls or fences on lot lines are party walls. Adjacent owners share repair costs equally (unless damage is caused by one owner, who then bears full cost).
