What Laredo at Western Skies's governing documents say
Laredo at Western Skies is a residential subdivision within the larger Western Skies master-planned community in Gilbert, Arizona. Individual lot owners join the Laredo Subassociation (governed by a board of directors) to maintain common areas and fund operations through per-lot assessments. This Parcel Declaration establishes governance and financial rules for the subdivision but defers to the overarching Master Declaration and Western Skies Community Documents on broader matters.
- What you own & maintain: You own your individual lot. The Subassociation maintains common open space (Tract A) and oversees golf course grounds (Tracts B-D), which are maintained by the Golf Course Operator at no cost to owners. You are liable only for damage caused by your own negligence or that of your tenants.
- Membership & voting: Lot owners automatically become members entitled to one vote per lot. Tenants have no voting or membership rights. Voting on major decisions requires 51% to 2/3 affirmative vote depending on the issue (general matters 51%, increased assessments or amendments 2/3).
- Annual assessments & fees: The initial annual assessment is $60 per lot, shared equally by all owners. This amount automatically increases annually by the greater of 10% or the U.S. Consumer Price Index increase, without owner approval. Assessments become a lien on your property; unpaid assessments accrue 12% annual interest plus a $25 late charge and can result in foreclosure and sale of your lot if not paid within 30 days of the due date.
- Special assessments: The board may levy special assessments (one-time charges for capital improvements, unexpected expenses, or common area taxes) only with 2/3 approval from voting members at a duly called meeting.
- Insurance & liability: The association maintains public liability insurance of at least $1,000,000 per occurrence and hazard insurance on common areas. Individual owner liability is limited by Arizona law.
- Rules & enforcement: The association may adopt reasonable rules for common area use and resident conduct. The board can suspend voting rights and common area access for owners in default on assessments, impose monetary penalties for violations, and pursue legal action to enforce compliance.
