What Val Vista and Warner Crossroads Center's governing documents say
This is a partial, ancillary amendment to the Declaration of Restrictions for Val Vista and Warner Crossroads Center, a commercial subdivision in Phoenix, AZ. It modifies certain rules only for specific lots purchased by Salt River Project (SRP). It does not contain the full set of community rules; the original Declaration and other documents still apply.
- Purpose of this amendment: Allows SRP to acquire Lots 3, 10, and 11 (the 'SRP Lots') and use them for a power plant, with certain exceptions from the original declaration.
- Common area & fencing: SRP may fence all or part of its lots to restrict access, but unfenced portions remain common area. Fencing must comply with codes and not obstruct access to other lots' common areas.
- Parking restrictions: While SRP excludes portions of its lots from common area, it cannot use common areas on other lots for parking, except for ingress/egress.
- Sign rights: SRP loses all sign rights under the original Declaration on its lots.
- Maintenance exception (lighting): SRP is exempt from the original Declaration's requirement for outdoor lighting hours of operation on Lot 3.
- Access drives: Access drives located entirely within SRP lots are eliminated; those on the boundary remain.
- Original declaration still applies: Except as amended, the original Declaration and Walgreen's Restrictions remain in full force for all lots, including SRP lots.
- What this document doesn't cover: This is only an amendment; it does not contain the original Declaration's rules on general maintenance, assessments, permitted uses, architectural control, or other standard commercial subdivision covenants.
