Heritage Cove At Wind Drift is a single-family home subdivision within the larger Wind Drift master-planned community in Gilbert, AZ. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) creates a homeowners association (HOA) that governs all lots in Heritage Cove. The rules bind all owners and occupants and are enforced by the HOA, subject to the overarching Master Declaration of Wind Drift.
- What you own & maintain: You own your lot and dwelling unit; the HOA owns and maintains Common Areas (like Tract C) and Association Land. The HOA also maintains landscaping and common improvements.
- Membership & voting: Ownership of a lot automatically makes you a member of the HOA. Each lot gets one vote if in good standing. The developer (Declarant) holds a separate Class B membership with extra votes that cease after 15 years or when other members' votes equal Declarant's.
- Assessments & fees: Annual assessments start at $480 per assessment unit (likely per lot) and can increase up to 10% per year without a membership vote. Special assessments require a two-thirds vote of a quorum. A one-time Purchaser Assessment of one-sixth of the current annual assessment is due at each lot transfer.
