Lindsay Meadow Estates is a 10-lot single-family residential subdivision in Gilbert, AZ, governed by deed restrictions and a homeowner association. Lots cannot be subdivided, and each can support one residence with minimum 2,000 square feet and 65-foot front width. Owners share irrigation system costs equally and must obtain architectural approval for all structures.
- Building requirements: Each lot supports one single-family residence (minimum 2,000 livable square feet with at least 65-foot front width) plus accessory structures like garages and barns. All structures must be set back 40 feet from the front, use roofs of tile, concrete tile, or natural wood shake, and prohibit window AC units. Construction must be completed within 12 months of building permit.
- Architectural approval: All structures require prior written approval from the Architectural Committee on design, location, and materials. The Committee has 30 days to respond; if no response, approval is not required unless the structure violates a specific restriction. Decisions require at least 3 lot representatives present.
- Vehicles & RVs: Boats, RVs, camping trailers, and motor homes cannot be stored or parked in front setbacks or on roads. No repairs, rebuilding, or maintenance work on these items is allowed on roads or within front setbacks. Guest RVs or trailers may park temporarily on the property if screened from street view.
- Animals & livestock: Horses and livestock (except swine) are permitted if kept according to all local laws and regulations. All animals must stay confined to the owner's lot unless leashed and under direct control. Animal housing must be maintained cleanly, and animals cannot create excessive noise or nuisance.
- Fences: Each owner maintains fences on their lot. When building a party fence, the builder covers all costs but the adjoining owner reimburses 50% when they build their residence. Animal containment fences must use galvanized steel with concrete posts (minimum 2" diameter, 3 rails minimum); no wood or barbed wire allowed.
- Shared irrigation costs: The shared surface irrigation system is funded equally by all lot owners regardless of water rights. Maintenance costs are split equally among all owners. If an owner damages the system, that owner bears the full cost of repair.
- Assessments & liens: Regular assessments for irrigation and association property are due within 15 days of notice and accrue 12% annual interest if unpaid. Non-payment results in a recorded lien against the lot (subordinate to prior mortgages). Voting rights suspend if payment is 15+ days overdue or violations are not cured within 15 days of notice.
