What Trilogy Golf Club's governing documents say
This document is an ancillary declaration that governs the use, maintenance, and operation of the golf course within the Trilogy Golf Club community in Gilbert, AZ. It primarily defines the golf privileges for homeowners (lot owners) and occupants, and sets out easements and cost-sharing arrangements between the golf course owner and the community association. It is not the full set of HOA rules for the residential community.
- Preferential Golf Rights: Designated Users (up to two per lot) receive advance tee time reservations (at least 2 days ahead of the general public) and a 20% discount on greens fees (excluding Fridays, Saturdays, Sundays, and holidays). Discount does not apply to cart rentals or other promotions. The golf course may close for up to 12 full days per year for private tournaments.
- Designated Users: Each lot's owner designates one or two Designated Users (owner or occupant). Changes can only occur every six months unless ownership changes. Tenants, guests, or family members who are not Designated Users cannot use the golf privileges. Designated Users may bring guests (up to a foursome per lot per day).
- Golf Cart Rules: Designated Users may use their own electrically powered golf carts on the course, subject to payment of a trail fee, proof of liability insurance naming the golf course owner as additional insured, and compliance with all applicable rules.
- Maintenance & Operation of Golf Course: The golf course owner (Responsible Party) must operate and maintain the 18-hole championship course to a standard consistent with similar residential golf communities. Night lighting on the course or driving range is prohibited except for occasional events. Maintenance work is restricted to between one hour before sunrise and one hour after sunset.
- Shared Facilities Cost Sharing: The golf course owner reimburses the association for use of the Entry Road and Parking Lot with an annual minimum of $7,500 or $0.25 per round of golf, adjusted annually by CPI. The owner also pays 31.58% of drywell operating, maintenance, and repair costs, plus a share of drywell reserve funds.
- Easements on Golf Course Property: The golf course property is subject to perpetual easements for the association's benefit: (a) access to and maintenance of perimeter fencing; (b) access to drywells; (c) removal of non-native species on mitigation parcels; (d) maintenance of a bridge and community monuments. The association must carry $1M liability insurance for its easement activities.
- Enforcement & Liens: If the golf course owner fails to perform maintenance, the association or declarant may perform the work and charge the owner plus 12% annual interest, secured by a lien on the golf course property. The association may also foreclose the lien. The prevailing party in any enforcement lawsuit recovers attorneys' fees.
