Citrus Well Co-Op is a non-profit water cooperative association for property owners within a specific parcel in Gilbert, AZ. It operates a shared well and furnishes water service to shareholders (each single-family residence owns one share, which passes with the land). These by-laws govern water usage, fees, and maintenance responsibilities.
- Share & voting: Each single-family residence in the co-op holds one share. Shares cannot be sold or transferred separately from the land. Each share has one vote; a simple majority carries. There are no elected officers; one person and an alternate are selected by rotation to oversee operations and collect fees.
- Fees & billing: Monthly water fee is $25 per residence, due quarterly in advance. Payments not received 60 days in arrears may be turned over to small claims court and water supply disconnected until all amounts owed are paid, plus a $100 penalty applied to future billing. Only certified funds are accepted. The caretaker sends quarterly statements showing account balance, expenses, and well account balance.
- Maintenance & repair costs: System maintenance, replacement, or improvements exceeding $500 require majority shareholder consent. If repair costs exceed the well account balance, the overage is divided equally among shareholders. Owners are responsible for prompt repair of leaks on their service line or plumbing, damage caused by residents/guests, and replacement of the service line connecting to the dwelling. Water lines in established easements are the co-op's responsibility except for direct damage by the owner or contractor.
- Water usage restrictions: Well water may only be used by shareholders for bona fide domestic purposes. Initial and subsequent filling of pools upon draining costs $25. Sprinkler use is limited to lawn areas; flood irrigation is prohibited. Pastures or gardens must use canal water. New additional uses require a shareholder vote. Shareholders must conserve water to ensure sufficient supply for all.
- Non-participating shareholders: Shareholders who have not developed their property and are not using the well still have voting rights but pay only $10.06 per month until construction begins on their parcel.
- Sewage setback: No element of an individual sewage disposal system may be located or relocated within 100 feet of the wells.
- Amendments: These by-laws may be amended at the annual business meeting by a majority vote of shareholders, cast in person or by written proxy.
