What Trilogy at Power Ranch's governing documents say
This is a partial amendment to the governing documents for Trilogy at Power Ranch, a master-planned community in Phoenix, AZ. It updates rules about assessments, reserve contributions for new and resale owners, and responsibilities for landscape easements. - Assessment types: The board may levy five types of assessments: base, special, benefited, reserve contribution, and capital contribution. This amendment defines these categories but does not specify amounts other than for reserve contributions.
- Reserve contributions for new & resale owners: First-Time Owners of lots numbered 1230 or higher pay a reserve contribution equal to that year's base assessment ($500 goes to reserve; the board may allocate the rest to capital). For lots 1229 or lower, they pay $500. Resale Owners on or after August 1, 2004 pay an amount equal to the base assessment; those acquiring before August 1, 2004 pay $250. Payments are nonrefundable.
- Landscape easements: Lots with recorded landscape easements require the owner to maintain all landscaping within the easement area, including irrigation, mowing, trimming, and replacing dead plants with like kind (or as approved by the Architectural Control Committee). No structures other than landscaping are allowed in these areas.
