Western Enclave is a standard single-family homeowners association (HOA) in Phoenix, AZ. This document is the full Declaration of Covenants, Conditions, and Restrictions that binds all owners, residents, and tenants. It establishes rules for residential use, architectural standards, maintenance obligations, and assessments.
- Architectural review: Any exterior construction or modification—including fences, landscaping, paint, and playground equipment—requires prior written approval from the Design Review Committee. The committee has broad aesthetic discretion; plans not acted on within 45 days can be deemed approved after a 30-day demand. No changes may be made to approved plans without new approval.
- Use restrictions & home businesses: All lots are for residential use only. Home businesses are allowed only if entirely invisible from outside, produce no extra traffic, employ no non-resident workers, and comply with all laws and community documents. Leasing a residence is not considered a business.
- Vehicles & parking: No commercial vehicles, mobile homes, trailers, boats, or similar equipment may be parked visibly. Vehicles must be parked in the garage if possible; otherwise, on the driveway. - Leasing & rentals: Owners may lease their entire lot and residence only. Leases must be in writing, with an initial term of at least 6 months, and must require the lessee to comply with all community documents. No subleasing or assignment allowed. The owner must notify the Association at least 10 days before the lease starts, providing term dates, occupant names, owner contact info, and an emergency contact. The owner remains liable for any rule violations by the tenant.
- Maintenance responsibilities: The Association maintains common areas, including access gates. Lot owners are responsible for maintaining their own property (including landscaping, fences, and exterior) to standards set by the Board. The Association may enter lots to inspect or correct violations.
