Grand-Aire Village is a subdivision in Glendale, AZ, governed by a 1963 Declaration of Restrictions that apply to all lot owners. The lots are designated for multiple dwelling units (four or more per lot), which may be attached or individual. These restrictions run with the land and were originally set to expire in 1993, with automatic 10-year extensions unless a majority of owners vote to change them.
- Land use & density: All lots are 'multiple dwelling lots' that may contain four or more family units per lot. Units may be attached or individual. No lot may be subdivided into smaller parcels for individual building purposes.
- Setbacks: Front walls must be at least 20 feet and no more than 35 feet from the front property line. Side walls must be at least 7 feet from the side property line.
- Construction requirements: All structures must be of new construction. No building that has been previously occupied may be moved onto a lot.
- Livestock & temporary structures: No poultry, fowl, goats, sheep, swine, cows, horses, or livestock of any kind may be kept on any lot. No garage, tent, shack, barn, trailer, or temporary structure may be occupied as a residence, except for storing tools during construction.
- Enforcement: Any lot owner may sue to restrain violations, recover damages, and obtain attorney's fees. A violation does not affect mortgage liens.
- Easements for utilities: The developer and assigns have an easement across all lots to install and maintain water, gas, sewer, drainage, electric, telephone, cable, and other utilities, with rights of ingress/egress and to trim vegetation that interferes.
- Signs: No billboards or advertising signs are allowed except one 'For Sale' or 'For Rent' sign per lot, no larger than 18x18 inches, with limited wording. Developer signs advertising lot sales are exempt.
- Duration & amendments: The restrictions were effective until July 1, 1993, and automatically extend for successive 10-year periods unless a majority of lot owners vote to change them.
