Casa Capricorn is a planned residential community (townhome association) in Phoenix, AZ. All owners and residents are bound by the covenants, conditions, and restrictions in this declaration, which governs use of lots and common areas.
- Architectural review: Exterior changes (construction, paint, landscaping) require prior written approval from the Board (or Architectural Committee). The Board has 30 days to decide; if no response, approval is deemed given. Fees may apply, and the Board can require a completion bond.
- Leasing & rentals: Leases must be in writing, include a 'Crime Free Lease Addendum,' and have a minimum term of 30 days. Owners must provide the association with a signed copy and evidence of a criminal background and credit check for all adult tenants.
- Pets: Only common domestic household pets (dogs, cats, birds) are allowed, kept solely as pets. No pet may exceed 40 pounds unless it aids a disabled resident. No more than two dogs per dwelling. Pets must be leashed (max 6 ft) outside, and owners must promptly remove droppings.
- Parking & vehicles: Each dwelling gets one assigned covered parking space; additional spaces may be assigned by the Board. Commercial vehicles (trucks over 1 ton, RVs, boats) are generally prohibited on common area except for temporary loading/unloading (max 24 hours). Family vehicles (pickups under 1 ton, SUVs, motorcycles) are allowed.
- Use restrictions: Lots are for single-family residential use only. Home businesses are allowed only if not detectable from outside, generate no extra traffic, and employ no more than one non-resident. Occupancy is limited to a single family: related persons or up to three unrelated individuals.
- Assessments & fees: Annual assessments fund common expenses and reserves. The initial maximum assessment was $1,080 per year, increasing automatically by up to 5% or the CPI each year. Special assessments require a majority vote of members. Owners pay equal shares; Declarant pays 25% of the standard rate.
