The governing document is the original Declaration of Horizontal Property Regime, which defines unit ownership, common areas, and the Association (Marian Lee Estates Association). It applies to unit owners and residents, outlining rights and obligations for the 120-unit project developed in two phases.
- What you own & maintain: You own the interior decorated surfaces of your apartment unit (walls, floors, ceilings) and an undivided interest in the common areas and facilities (land, roofs, main walls, private drives, community facilities, etc.). - Party walls: Walls on the dividing line between units are party walls. If one owner damages a party wall, that owner must repair at their own cost. If damage is from other causes, both adjoining owners share repair costs equally. Disputes go to arbitration.
- Use restrictions: Units must be used only as private dwellings. No partition of common areas is allowed. Owners cannot exempt themselves from assessments by waiving use or abandoning their unit.
