What Paseo Place Reamended's governing documents say
Paseo Place Reamended is a single-family residential planned area development (PAD) in Glendale, Arizona — you own your individual lot and home, and the Paseo Place Improvement Association maintains shared open spaces and recreational facilities. The governing covenants (originally recorded May 1974, amended through 1974) establish comprehensive HOA rules on land use, architectural changes, and property maintenance.
- Community structure & permitted uses: You own your individual lot with home; the association owns and maintains common areas (open space, landscaping, recreational facilities). Properties are restricted to single-family residential use only — no commercial, business, professional, institutional, or religious use is permitted.
- Assessments & fees: The initial maximum assessment was $22.85 per month per lot (1974 recording). Annual increases are capped at 5% by board vote; increases exceeding 5% require a two-thirds member vote. Payments not made within 30 days of due date accrue 6% annual interest, and assessments are a lien on the property.
- Home size & construction requirements: Any dwelling must have a minimum ground-floor area of 1,100 square feet (excluding garages, carports, and pergolas). Only new construction is allowed; existing structures cannot be relocated onto a lot. You may build patio walls, garage, carport, and an optional pool.
- Architectural review & board approval: Board approval is required before constructing any building, fence, wall, or exterior addition or alteration. You must submit plans showing nature, materials, color, design, height, and location. The board has 30 days to decide; if they don't respond, approval is deemed granted.
- Renting & leasing: Only the entire lot with home may be rented, and only to a single-family tenant. The documents do not specify minimum lease terms or restrictions on short-term rentals.
- Pets & animals: Only commonly accepted household pets are allowed for personal use (not for breeding or commercial purposes). No horses, other animals, or birds may be kept without written board consent.
- Vehicles & parking: Trucks, vans, buses, trailers, boats, and campers must be kept in carports or garages — not in streets or front yards. Exception: work vehicles during daylight hours. Passenger cars and station wagons are unrestricted.
- Party walls & shared wall liability: For walls built on lot lines, liability for repair is split: if you cause damage through your own act, you bear the full cost; if a party wall is damaged by other causes (weather, age), both adjoining owners share the cost equally. Disputes are resolved by arbitration or a Superior Court judge.
