What Braemar Estates's governing documents say
Braemar Estates No. 3 is a standard single-family home subdivision in Glendale, AZ, governed by a Declaration of Restrictions that run with the land, binding all lot owners. This document primarily restricts how lots can be used and built upon, with no mention of an association, common areas, or mandatory fees.
- Use of property: Each lot is limited to one single-family private residence with a garage. No business, apartment, lodging, or hospital use is allowed. Temporary structures like tents or trailers are prohibited until the main residence is complete.
- Leasing & rentals: Only an entire lot (with its improvements) may be rented or leased; renting a room or part of the residence is prohibited.
- Minimum size & construction: Every principal residence must have at least 1,000 square feet of enclosed living area (excluding porches, garage, and outbuildings). Construction must be completed before occupancy.
- Architectural review: All building plans, including location, exterior color, fences, and walls, must be approved in writing by an architect or agent appointed by the developer. Disapproval can be based on design harmony with surroundings. Approval must occur within 30 days of submission.
- Livestock & animals: No cattle, sheep, horses, goats, pigs, rabbits, poultry, or other livestock are allowed on any lot.
- Signs & nuisances: Only one 'For Rent' or 'For Sale' sign per lot is permitted. No billboards, unsightly objects, or nuisances are allowed. Clotheslines, woodpiles, and storage areas must be screened from neighboring lots.
- Waste & maintenance: No rubbish or offensive activity may be stored or carried on any lot. Noise, odor, or anything that disturbs the peace of neighbors is prohibited.
- Duration & amendment: The restrictions run with the land until January 1, 2001, and then automatically extend for successive 10-year periods unless a majority of lot owners vote to change them. The original developer retains the right to amend until all lots are sold.
