Sunburst Farms Twenty-One is a single-family home subdivision in Glendale, AZ, governed by CC&Rs recorded in 1973. - What you own & maintain: You own your lot and the residence on it. The association (Sunburst Farms (Glendale) Mutual Water and Agricultural Company) maintains irrigation water delivery and tillage service for most lots (lots 815–879 are excluded from irrigation). You must maintain your property in a manner that does not depreciate the overall project, and the association may improve your property used for water delivery and charge you.
- Land use & building restrictions: Lots are limited to single-family residences only. Minimum ground floor area is 1,050 square feet (excluding open porches, pergolas, or attached garage). Setback: front wall at least 20 feet from front property line (porch/garage may project 5 feet), side walls at least 15 feet from side lines. Stables, livestock shelters, and tack rooms are allowed but must be at least 25 feet from the main residence and 20 feet from side property lines.
- Fences, walls & hedges: Solid walls or fences over 5 feet high are prohibited near the front street line. Side or rear walls/fences may be up to 6 feet high. Hedges over 3 feet high are not permitted within 20 feet of the front property line. Corner lots have special setback rules for measuring fence height.
- Livestock & poultry: Horses, poultry, and livestock may be kept for the owner’s personal use and enjoyment, subject to laws and health codes. Facilities must be maintained cleanly and not become a nuisance, with at least 70 feet setback from the front property line. Commercial animal husbandry is prohibited.
- Association membership & fees: Ownership of a lot automatically grants one membership in the association. Members pay charges set by the board for irrigation water and tillage service. Delinquent charges become a lien on the lot, subordinate to first mortgages, with 5% annual interest. The association may enforce collection and foreclose on the lien, and the owner pays attorneys’ fees if the association prevails.
- Covenant enforcement & duration: Violations may be pursued in court by the association or any lot owner, with violators liable for attorneys’ fees. The covenants originally expired January 1, 2003, but automatically extend for successive 10-year periods unless a majority of lot owners vote to amend or revoke them. While the developer holds a majority, FHA/VA approval is needed for amendments.
