This is the Declaration of Covenants, Conditions and Restrictions for Hallcraft Villas Glendale, a townhouse community in Glendale, AZ. It governs the rights and obligations of lot owners in a townhome project with party walls. The Hallcraft Villas Glendale Townhouse Association is responsible for maintaining common areas and providing exterior maintenance for each lot.
- Party walls: Walls on the dividing line between townhome units are party walls. Each adjoining owner shares the cost of repair for damage from natural causes; if one owner causes the damage, that owner bears the full cost. Any modification to a party wall requires written consent from the adjoining owner.
- Architectural review: No building, fence, wall, or other structure may be erected or altered without written approval from the Board of Directors or an architectural committee. Plans must be submitted showing nature, shape, height, materials, and location. If no decision is made within 30 days, approval is deemed given.
- Exterior maintenance: The Association provides exterior maintenance for each lot, including paint, repair, and replacement of roofs, gutters, downspouts, exterior surfaces, trees, shrubs, grass, walks, and other exterior improvements (excluding glass surfaces). If damage results from the owner's negligence, the cost is added to that lot's assessment.
- Interior and other maintenance: Each owner is responsible for maintaining the interior of their townhome, individual patios, and any areas not maintained by the Association. Owners must also maintain fixtures and equipment inside the unit and handle termite control. No act may impair easements or adversely affect other units.
- Use restrictions: Premises are restricted to residential use. No temporary structures, trailers, or outbuildings as residences. Pets (dogs, cats, or other household pets) are allowed but not for commercial purposes. Only one "for rent" or "for sale" sign per lot, up to 5 square feet. No business activities on the premises except by the builder during construction/sale. Clotheslines must be in patio areas and screened. Exterior antennas require prior Board approval.
- Parking: Each lot owner is entitled to use up to two automobile parking spaces, assigned by the Association, with reasonable proximity to the lot. Includes rights of ingress and egress in the parking area.
- Assessments: Each lot owner must pay annual and special assessments to the Association. The maximum annual assessment initially was $360 per lot, and may increase up to 3% per year without a membership vote. Increases above 3% require a two-thirds vote of each class of members. Assessments are a lien on the lot and a personal obligation of the owner. Delinquent assessments bear 6% annual interest.
- Damage and destruction: If a common element is damaged by an owner or their guests, the owner must reimburse the Association for repairs. If a townhome is damaged, the owner must contract for repairs within 60 days and complete within 6 months, or the Association may do so and place a lien on the property. Disputes go to arbitration.
