What The Pines Homeowners Association's governing documents say
This is the Architectural Guidelines document for The Pines at South Mountain Homeowners Association, a single-family home community in Phoenix, AZ. It supplements the full CC&Rs and applies to homeowners (owners) who want to make exterior changes to their property. The guidelines detail what requires prior approval from the Architectural Committee and set specific standards for modifications.
- Architectural review process: All exterior modifications, including landscaping, painting, structural additions, and changes to hardscape, require prior written approval from the Architectural Committee (AC). Submit an Architectural Change Form with detailed plans; the AC will approve or deny within 30 working days after receiving all requested information. If no response within 30 days, approval is deemed given. Work must be completed within the specified time, and the homeowner is responsible for obtaining city permits.
- Parking & vehicles: Parking is allowed only in your garage or on your concrete driveway; vehicles must not extend onto sidewalks. Between midnight and 4 a.m., no parking is allowed except for guests with a temporary permit (max 48 hours in a 7-day period) and temporary construction vehicles. Recreational vehicles may be parked for loading/unloading up to 48 consecutive hours (max 72 hours per week). Violators may be towed at the owner's expense.
- Landscaping & plants: Front yard landscaping changes always require AC approval; rear yard changes require approval only if visible from the street or neighboring property. Only plants from the current approved plant palette are allowed; plants from previous palettes must be removed. Shrubs may not exceed 8 feet in height and must maintain 18 inches clearance from driveway edges. The front yard ground cover must be chocolate brown landscape stone.
- Exterior paint & colors: All exterior painting requires prior AC approval using the current approved paint palette. Color matching for partial repaints is not permitted. The paint palette and color guidelines are separate documents available from the property manager or HOA website. Painting must be done with colors that are currently approved for the community.
- Fences, walls & gates: Changing or modifying party walls requires written consent from adjacent lot owners. Wrought iron fences on greenbelt lots may not be removed. View walls must combine masonry and wrought iron (minimum 2 ft masonry with 4 ft wrought iron to maximum 6 ft masonry). Masonry must match existing wall color and texture. Wrought iron must be painted black. Homeowners are responsible for the interior side of walls; HOA is responsible for the exterior side facing greenbelts.
- Flags & decorations: Only one permanent flagpole per lot is allowed, either wall-mounted (max 5 ft long) or freestanding (max 15 ft tall or lower than roofline). Flags must be 3 feet by 5 feet or smaller and can only display the American flag, official military flags, POW/MIA, Arizona state, an American Indian tribal flag, or the Gadsden flag. Holiday decorations must be removed within 30 days after the holiday. Bird feeders, bug lights, and yard decorations are not allowed in front yards or on street-facing window sills.
- Pools & spas: Private pools and spas require a city permit and AC approval. The pool, pipes, pumps, and decking must stay within your property line, respecting the neighbor's 5-foot setback. All equipment must be concealed from street and neighbor views and must not be attached to party walls. Pools must not be drained into common areas. During construction, the homeowner must maintain a barrier and restore any damaged walls or landscaping to original condition.
