The covenant runs with the land and binds all current and future owners.
- Water fees & obligations: Each parcel is subject to a Replenishment Assessment (annual, based on groundwater use), an Activation Fee (per-unit amount set by CAWCD, due before any public report for sale or lease), and a Replenishment Reserve Fee (two times the annual Replenishment Reserve Charge multiplied by projected excess groundwater demand, also due before a public report). Long-term storage credits may substitute for the Reserve Fee with approval.
- Lien for unpaid fees: If any Replenishment Assessment, Activation Fee, or Replenishment Reserve Fee is not paid when due, it becomes a continuing lien on the parcel and a personal obligation of the owner at the time it came due. CAWCD has the rights and remedies provided by Arizona law to collect.
