The Southwest Corner of McDowell Road and Pebble Creek Parkway is a commercial shopping center development in Goodyear, AZ. These Covenants, Conditions, Restrictions and Easements (CC&Rs) bind the owners of individual parcels (fee simple holders) and govern the use, development, and maintenance of the entire shopping center. This document establishes a plan for an integrated commercial development, including common areas, assessments, and design controls.
- What you own & maintain: You own your parcel in fee simple. You are responsible for all buildings, improvements, and common areas on your parcel (e.g., landscaping, driveways, lighting, trash facilities), except for certain common areas maintained by Declarant. You must keep your property in a condition consistent with first-class neighborhood retail/office developments in the Phoenix metro area.
- Assessments & fees: Common Area Expenses are assessed against each owner based on the gross square footage of their parcel's land area divided by the total land area in the Development. A management fee up to 15% of costs (other than insurance) is included. Assessments are a continuing lien on the parcel and a personal obligation of the owner. Late payments accrue interest at the Default Rate (the greater of 15% per annum or 5% plus the Federal Reserve discount rate).
- Development & construction: All building construction must be within designated Building Envelopes and approved by Declarant. Preliminary and final plans must be submitted for approval (approval deemed if no response within 30 days after a notice). Construction must be completed within 12 months of commencement. No party walls without Declarant consent. Alterations to exteriors or common areas require Declarant approval.
- Use restrictions: The development is for commercial uses only. No overnight semi-truck parking except on Parcel 9 (as shown on Site Plan). No vending machines in common areas without consent (except ATMs). No displays, carnivals, or political demonstrations in common areas without Declarant consent. No obnoxious odors or nuisances. Rules and regulations may be adopted by Declarant.
- Parking & vehicles: All vehicles must park only in marked spaces within common areas. No 'reserved' parking without Declarant consent (except handicap spaces). Employees must park on their own parcel unless employee parking areas are designated by Declarant or all owners. Overnight parking of semi-trucks is prohibited except on Parcel 9.
- Signage: Shared Signs (pylon, monument, etc.) along McDowell, Pebble Creek, and I-10 are maintained by Declarant, with costs allocated among owners. Owners may place sign panels on Shared Signs only with Declarant's permission. All signage must comply with City requirements and be approved by Declarant.
- Maintenance obligations: Declarant maintains common areas (drive surfaces, landscaping, lighting, sidewalks, etc.) and recovers costs via assessments. Owners maintain their own buildings, parking, trash facilities, and certain other improvements. Graffiti must be removed within 2 business days after notice; if not, Declarant may do so at owner's expense plus 5% admin fee.
