What Cardenas Villas @ Yanche's governing documents say
Cardenas Villas @ Yanche is a planned community of 46 single-family lots in Guadalupe, AZ, governed by a homeowners' association (HOA). This Declaration sets the rules for all owners, residents, and guests, covering use, maintenance, assessments, and architectural control.
- Property type & ownership: You own a lot and dwelling unit; the association manages common areas (Tracts A and B) and enforces the rules. Membership in the HOA is automatic with ownership.
- Land use & occupancy: Each lot is for single-family residential use only. Occupancy is limited to a 'Single Family' (related persons or up to 3 unrelated individuals). Commercial activity is prohibited unless home-based and unnoticeable.
- Pets: No more than three household pets per lot. Pets must be kept in the dwelling, fenced yard, or on a leash. No animal structures visible from neighboring property without board approval. Owners must immediately remove pet droppings.
- Parking & vehicles: No vehicles with payload over 3/4 ton, no boats, campers, or trailers visible from neighboring property or streets. Exceptions for SUVs, small pickup trucks, and mini-motor homes under 7 ft height and 18 ft length. Inoperable vehicles cannot be stored visibly. Garages must be used for parking, not conversion to living space.
- Signs & structures: No signs visible from neighboring property except up to 2 residential identification signs (max 144 sq in each), up to 3 open house signs (max 3 sq ft each), and other signs approved by the board or required by law. Basketball backboards, flagpoles, and play structures require board approval if visible.
- Leasing & rentals: Leases are allowed; no minimum term is stated. Lessees have rights to use common areas during the lease. The owner remains responsible for violations by tenants. The board can suspend common area use for delinquent owners or rule violators.
- Assessments & fees: Annual assessments initially $60 per lot, can increase up to 10% or CPI each year without member vote. Higher increases need approval of 2/3 of each membership class. Special assessments require 2/3 vote. New owners pay a one-time working capital fee equal to 1/4 of the current annual assessment. Delinquent assessments accrue 15% interest and may lead to liens and foreclosure.
- Architectural review: Until the last lot is sold, the declarant controls exterior changes. After that, the board may adopt architectural guidelines. Any exterior alteration, including color, fencing, landscaping, must receive prior written approval. The board can establish rules for satellite dishes per federal regulations.
