Cypress on Sunland is a standard single-family home HOA in Guadalupe, AZ (near Phoenix). This Declaration of Covenants, Conditions, Restrictions & Easements is the primary rulebook for all lot owners (137 lots) and is legally binding. It covers everything from fees and architectural control to parking, pets, and maintenance responsibilities. Note: This document is long and detailed; only key provisions are summarized below.
- Assessments & fees: The maximum annual assessment initially is $24 per month per lot, payable monthly. Starting in 2004, it automatically increases each year by the greater of 10% or the CPI rate. Special assessments for capital improvements require a 2/3 vote of members. Unpaid assessments accrue 12% interest and can become a lien on the lot.
- Architectural review: Any exterior change (including color, materials, fences, sheds, antennas, etc.) requires prior written approval from the Architectural Committee (appointed by the Board). Plans are deemed approved if not acted on within 60 days. Basketball standards visible from neighboring property are strictly prohibited. Storage sheds must not exceed 6 feet in height and must match house color or be neutral.
- Use restrictions – residential only: All lots are for single-family residential use only. No businesses, professions, or trades. Leasing is allowed but must be in writing and subject to the Declaration; the owner remains liable for tenant compliance. No temporary dwellings (RVs, trailers) as residences. No subdivision of lots. No antennas visible from neighboring property (satellite dishes must be below fence line).
- Vehicles & parking: No vehicles exceeding 1 ton rating, mobile homes, trailers, boats, or recreational vehicles over 7 feet tall or 18 feet long may be parked visibly. Parking is limited to garages, driveways, and designated areas; on-street parking is discouraged. Inoperable vehicles and vehicle repair are prohibited. Mini motor homes and pickups under 1 ton used for regular transportation are allowed if parked in garages or driveways.
- Pets & animals: A reasonable number of recognized domestic house or yard pets are allowed, but not for commercial purposes. They must not create unreasonable noise or nuisance. Structures for pets must not be visible from neighboring property.
- Maintenance responsibilities: The Association maintains all common areas and front yards (including landscaping installed by Declarant). Owners must not alter front yard landscaping. Owners maintain the remainder of their lots (lawns, buildings) free of weeds and debris, and keep improvements in good repair.
- Party walls & fences: Rules for shared walls/fences between lots: both owners equally use and share repair costs (unless damage caused by one owner). Walls adjacent to common areas are treated as party walls with the Association. Color changes on surfaces visible from streets/common areas need Architectural Committee approval.
