This document is the full Declaration of Condominium that governs all unit owners and the association.
- Permitted use & zoning: All units are restricted to uses allowed by the City of Tempe I-1 zoning. No residential use is permitted. No noxious, offensive, or hazardous activities are allowed, and no mobile storage, junk, or salvage storage is permitted.
- Architectural review: The Board of Directors acts as an Architectural Control Committee. All exterior alterations, signs, fences, additions, or changes to color must be approved in advance by unanimous Board vote. Plans must be submitted; approval is deemed if the Board fails to act within 30 days (with possible 30-day extension).
- Signs & exterior appearance: Only approved name/address signs are allowed. No spotlights, floodlights, reflective materials, window air conditioners, external antennas, or exterior speakers are permitted unless approved. All refuse must be screened, and no open storage is allowed.
- Parking & vehicles: Adequate on-site parking must be provided; on-street parking is to be avoided. Truckwells are common elements and may be used by one owner for no more than 90 minutes. The Board may prohibit vehicles that create noise or are unsightly.
- Maintenance responsibilities: Each owner maintains the interior of their unit and limited common elements (e.g., assigned parking). The association maintains exterior walls, roofs, landscaping, walkways, driveways, and common mechanical equipment. If an owner fails to maintain, the association may enter and repair at the owner's cost.
- Assessments & liens: Annual assessments are based on undivided interest in common elements. Special assessments require 60% vote. Delinquent assessments incur 5% late fee and 18% annual interest, and are secured by a lien on the unit enforceable like a mortgage. Failure to pay may also result in suspension of voting rights.
