Twin Hawks Estate is a standard single-family home subdivision in Marana, AZ (Pinal County), governed by a Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that bind all lot owners. These rules preserve the rural residential character through minimum lot sizes, site-built homes, and strict use restrictions.
- Minimum lot size: No dwelling may be built on a parcel smaller than 4 acres. The recorded minimum lot size is 4.7 acres, but an existing restriction prohibits building on parcels under 4 acres.
- Dwelling size & construction: All homes must be site-built with new materials, have at least 1,400 square feet of living area (excluding garage, porches, patios), and include a garage or carport of at least 600 square feet within one year of occupancy. No manufactured homes, mobile homes, geodesic domes, Quonset huts, prefabricated or modular homes are allowed, except temporary trailers during construction for up to 18 months.
- Setbacks: Dwellings must be set back at least 75 feet from the parcel boundary, unless adjacent owners sign mutual agreements to reduce the setback.
- Animals: No commercial livestock or poultry operations. Domestic pets and horses for personal enjoyment are allowed. Animals must not run free. Barking dogs determined a nuisance by a 66% vote of owners (by number and acre) must be trained or fitted with a device to stop nuisance barking.
- Vehicles & storage: Non-operative or disassembled vehicles, parts, trailers, and boats must be stored hidden from view (enclosed building, fence, or vegetation). Off-road vehicles may not be operated repetitively (racing, circular) on the property or internal roads, but ingress/egress is allowed.
- Landscaping & vegetation: Removal of trees over 4 inches in diameter (measured 1 foot above ground) is prohibited unless absolutely necessary for construction. Native vegetation clearing is limited to 85,000 square feet per parcel (excluding existing easements). Clearing beyond that requires replanting at owner's expense.
- Outdoor lighting: All exterior lights must be shielded so the direct light source is not visible from neighboring parcels.
- Duration & modification: The restrictions run with the land until the start of the year 2020, and automatically renew for successive 10-year periods unless owners of 2/3 of the total area vote to terminate. Modification requires a written agreement recorded by owners of at least 75% of the parcels.
